1. Who we are

BetaBuilds Software Solutions ("BetaBuilds", "we", "us") is a software, web and design agency based in Cape Town, South Africa. We are the responsible party for the personal information described in this policy, and we process it in line with the Protection of Personal Information Act, 2013 (POPIA).

2. Information we collect

Our website does not have a contact form, and we do not ask you to create an account. We only receive your personal information when you choose to contact us or work with us.

We only collect what we need. Please do not send us sensitive personal information (such as ID numbers or health information) unless we specifically need it for your project.

3. How we use your information

• To reply to your enquiry and prepare a quote or proposal.
• To schedule consultations and send you a calendar invitation.
• To deliver, host, maintain and support the services you hired us for.
• To send invoices, receive payments and keep financial records.
• To communicate with you about your project or monthly plan.
• To keep our website and systems secure and working properly.
• To meet our legal and tax obligations.

We process your information because you have asked us to (consent), because it is needed to provide our services under our agreement with you, because the law requires it, or because it is in our legitimate interest to run our business, as POPIA allows.

4. Who we share it with

We never sell your personal information. We use the following service providers to run our website and business:

These providers process information under their own privacy policies and security controls. We may also disclose information where the law requires it.

Client websites in our portfolio: our home page shows live previews of websites we built for clients. These previews load the client's own website inside ours, so that website may collect information or set cookies under its own privacy policy. We do not receive or control that information.

5. Storage outside South Africa

Some of our service providers store data on servers outside South Africa, for example in the United States or Europe. We only use reputable providers that protect personal information to a standard similar to POPIA, through their privacy and security commitments. By using our services, you acknowledge that your information may be transferred in this way.

6. Data we handle for our clients

When we build or host systems for a client (for example a booking form on a client's website), personal information submitted by that client's customers belongs to the client. In that case the client is the responsible party and we act as their operator. We only process that information on the client's instructions, keep it secure and confidential, and do not use it for our own purposes. Questions about that information should go to the relevant business first.

7. How we protect your information

• Secure, encrypted connections (HTTPS) on our website and the systems we build.
• Access limited to the team members who need it for your project.
• Passwords and access details stored in a password manager, never in plain text or chat messages where avoidable.
• Reputable providers with their own security controls, and regular backups.

8. How long we keep it

• Enquiries and consultation bookings that do not become projects: up to 12 months, then deleted.
• Client and project records: for as long as we work together, then up to 5 years for tax and legal purposes.
• Account access details: removed or handed back when the project or support plan ends.

After that, we securely delete or anonymise the information.

9. Marketing

We only send marketing messages to existing clients about services similar to the ones they already use, or to people who have agreed to receive them. Every message gives you a way to opt out, and you can also tell us at any time by email or WhatsApp.

10. Cookies

Our website does not set any cookies, and does not use browser storage, analytics or advertising trackers. The client websites shown as live previews on our home page may set their own cookies (see section 4). If we ever add analytics or tracking, we will update this policy and, where required, ask for your consent first.

11. Your rights

Under POPIA, you have the right to:

• Ask whether we hold personal information about you and request a copy of it.
• Ask us to correct or update information that is wrong or out of date.
• Ask us to delete information we no longer have a lawful reason to keep.
• Object to us processing your information, including for marketing.
• Withdraw your consent at any time, where we rely on consent.
• Lodge a complaint with the Information Regulator.

To use any of these rights, contact our Information Officer using the details below. We may need to confirm your identity first, and we will respond within a reasonable time.

12. Children

Our services are aimed at businesses and adults. We do not knowingly collect personal information from children under 18 through this website. If you believe a child has sent us their information, please contact us and we will delete it.

13. Security incidents

If we have reason to believe your personal information has been accessed or acquired by an unauthorised person, we will notify you and the Information Regulator as soon as reasonably possible, as POPIA requires.

14. Changes to this policy

We may update this policy from time to time. The latest version will always be on this page, with the effective date at the top.
