1. About us

This website is operated by BetaBuilds Software Solutions ("BetaBuilds", "we", "us", "our"), a youth-led software, web and design agency based in Cape Town, South Africa.

2. Accepting these terms

These terms apply when you use this website and when you hire us for any service. By using the website, accepting a quote, or paying a deposit, you agree to these terms.

If a written proposal, quote or project agreement we have both accepted says something different from these terms, the proposal or agreement applies for that project.

3. Our services

We offer web development, web design, responsive design, logo design, poster design, and SEO and digital marketing, as described on our Services page. We also offer custom software and ongoing monthly support and design plans. The exact work we will do for you is set out in your proposal or quote.

Timelines and examples: delivery times, project examples and descriptions on our website are general guides based on past work. Your actual timeline is the one stated in your proposal, and it depends on the project's size and on receiving your content and feedback on time.

4. Quotes and proposals

• Every project starts with a discovery conversation, after which we send a written quote or proposal.
• Quotes are valid for 30 days from the date they are sent, unless the quote says otherwise.
• A quote covers only the work described in it. Anything not listed is out of scope and will be quoted separately.
• Prices are in South African Rand (ZAR).

5. Payment

• Projects: a 50% deposit is due before work starts. The balance is due before the project goes live or before final files are handed over.
• Smaller jobs: design work and other jobs under R1,000 are paid in full upfront.
• Monthly plans: billed in advance on the 1st of each month.
• Invoices are payable within 7 days unless the invoice says otherwise. If payment is late, we may pause work, support or managed services until the account is up to date.
• Third-party costs are paid by you unless your quote says they are included. These include domain names, paid hosting, software licences, paid plugins, advertising spend and printing.

6. Revisions and changes

Each quote states how many rounds of changes are included. Further changes, or new work outside the agreed scope, are charged at our hourly rate or quoted separately. We will always tell you before doing paid extra work.

7. Your responsibilities

• Provide the content, images, logins and feedback we need, on time. Delays on your side may move the project timeline.
• Make sure you have the right to use any content, images, logos or trademarks you give us, and that your business information and claims (for example prices and guarantees) are accurate and lawful.
• If a project is paused for more than 30 days because we are waiting on you, we may close it and invoice for the work completed. We are happy to reopen it later under a new quote.

8. Monthly plans

• Monthly plans have a minimum term of 3 months, after which they continue month to month.
• After the minimum term, either of us can cancel with 30 days' written notice (email or WhatsApp is fine).
• Design requests for the next month should reach us by the 25th. Unused allocations (for example designs or support hours) carry over for one month only and are not refundable.
• We may update plan prices with at least 30 days' written notice.

9. Cancelling a project

You may cancel a project at any time by telling us in writing. You will pay for the work completed up to the date of cancellation. Your deposit is first applied to that work, and any remaining balance is refunded, less a reasonable cancellation charge where the law allows it.

We may end a project if payment is not made, if the work requested is unlawful, or if communication becomes abusive. In that case you will pay only for the work completed.

10. Ownership of work

• Once you have paid in full, you own the final designs, content and website or application we created specifically for you.
• We keep ownership of our own pre-existing code, tools, templates and frameworks used to build your project, and give you a permanent licence to use them as part of your project.
• Until full payment is received, all work remains the property of BetaBuilds.
• Unless you ask us not to in writing, we may show your project in our portfolio, case studies and social media.
• Software we offer on a subscription basis (for example a booking or management platform) remains our property. You receive the right to use it while your subscription is active.

11. Third-party services

Our work often relies on third-party services such as hosting providers, databases, payment providers, WhatsApp and Google. These services have their own terms, and we are not responsible for their outages, price changes or policy changes. Where possible, accounts for your domain and key services should be registered in your name.

12. Support after launch

For 30 days after launch, we will fix any defects in the work we delivered at no charge. This does not cover new features, changes in scope, or problems caused by changes made by you or a third party. After that period, support is available through a monthly plan or at our hourly rate.

13. Limitation of liability

We work carefully, but we cannot guarantee specific business results such as search rankings, sales or leads. To the extent the law allows, we are not liable for indirect losses such as lost profits, lost data or business interruption, and our total liability for any claim is limited to the fees you paid us for the service in question in the 3 months before the claim.

Nothing in these terms limits any rights you have under the Consumer Protection Act, 2008, or any other law that cannot be excluded.

14. Using this website

• The content on this website is for general information and may change without notice.
• You may not copy our content, designs or code for commercial use without our written permission.
• You may not misuse the website, for example by attempting to break into it, overload it, or submit spam or harmful content through our forms.
• Links to other websites, and live previews of client websites shown in our portfolio, are provided for convenience. Those websites belong to our clients or other third parties, and we are not responsible for their content or how they handle your information.

15. Privacy

We handle your personal information in line with the Protection of Personal Information Act, 2013 (POPIA). Please read our Privacy Policy to see what we collect and how we use it.

16. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa. If a problem comes up, please contact us first so we can try to resolve it together. If we cannot agree, either party may refer the matter to a court with jurisdiction in South Africa.

17. Changes to these terms

We may update these terms from time to time. The latest version will always be on this page, with the effective date at the top. Changes do not affect projects already agreed in writing unless we both agree.
